THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM MINIRETRO OR THROUGH THE SERVICE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

We do not guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results that may be obtained from the use of the Service will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations
• Any errors in the Service will be corrected

YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MINIRETRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory
• Bugs, viruses, trojan horses, or the like which may be transmitted to or through our Service by any third party

IN NO EVENT SHALL MINIRETRO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS, DAMAGES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT FULLY APPLY TO YOU.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Not share your account credentials with others

You are responsible for all content you create, upload, or share through the Service.

You retain ownership of any content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute such content solely for the purpose of providing and improving the Service.

• The content is not illegal or harmful

We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

The Service and its original content, features, and functionality are owned by MiniRetro and are protected by international copyright, trademark, and other intellectual property laws.

MiniRetro, the MiniRetro logo, and all related marks are trademarks of MiniRetro. You may not use our trademarks without our prior written consent.

These Terms do not grant you any right to use the MiniRetro name or any trademarks.

Certain features of the Service are available on a paid subscription basis. By subscribing to our paid services, you agree to pay the applicable fees and charges.

Subscription fees are:

• Billed in advance on a recurring basis (monthly or annually)
• Non-refundable except as required by law
• Subject to change with 30 days notice

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period.

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MiniRetro is established, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration, except where prohibited by law. You and MiniRetro waive any right to a trial by jury.
